- GENERAL PROVISIONS AND DEFINITIONS:
- Online Service/ the Service – the service located at web pages https://www.audioguidegdansk.pl and http://www.audioguide.com.pl. kept by Przemysław Diering, who conducts business activities under the name Mexpo Przemysław Diering, ul. Pułaskiego 8, 81-368 Gdynia, NIP [tax id. no.]: 5841076375, hereinafter the Service Provider.
- Ticket –a file in PDF format, sent to an email address provided by a Client; which includes payment confirmation, a unique number and QR code; it is only confirmation of concluding a contract.
- Voucher –a file in PDF format, sent to an email address provided by a Client; which includes a unique number and QR code
- Tourist information office – Pomeranian Tourist Information Centre, Brama Wyzynna, Waly Jagiellonskie 2a, 80-887 Gdansk.
- Audio Guide equipment – devices with installed city audioguide in various languages.
- User – each person who visits Online Service and its subpages.
- Audio Guide Gdańsk App – application downloaded on a smartphone compatible with Android operating system through Google Play store.
- ELECTRONIC SERVICES IN ONLINE SERVICE
- Online service enables the following electronic services: purchasing a ticket or downloading a free voucher, purchasing unlock code for Audio Guide Gdańsk App Broadcast.
- Ticket entitles you to rental of a number of Audio Guide devices in tourist information office for special price that is adequate to the type of a purchased ticket. Types of tickets, their prices and discounts are listed on the pages of Online service.
- Voucher entitled you to disposable discount of one Audio Guide device while renting Audio Guide equipment in tourist information office.
- TERMS AND CONDITIONS OF CONCLUDING ELECTRONIC CONTRACTS
- Concluding a contract between parties includes: placing an order for a ticket and providing a payment by a Client, or downloading a free voucher, or purchasing an unlock code for Audio Guide Gdańsk App Broadcast by online service. Unlocking a broadcast is also available in Audio Guide Gdańsk App Google Play service.
- A contract is performed by providing a paid up ticket/ voucher by electronic means to a Client.
- A contract between parties is concluded once a Client receives an email with an attached ticket/ voucher.
- Recording, securing and releasing the contents of a concluded contract to Client takes place through releasing this Terms and Conditions on the web page of online service and sending an email to a Client.
- In order to use the purchased ticket or downloaded voucher, you must rent Audio Guide device.
- The language of a contract is also the language of Terms and Conditions. In the case of a dispute, the Polish version shall prevail.
- The Service Provider reserves the right to introduce modifications to the Terms and Conditions.
- PAYMENT METHODS AND DATES
- The Service Provider enables electronic and card payments for purchased tickets through agencies: PAYPAL.COM, PAYu.pl or DOTPAY.PL.
- The Company PayPal (Europe) S.à r.l. et Cie, S.C.A. (headquarters: R.C.S. Luxembourg B 118 349), entered into the Register of Luxembourg Financial Supervision Authority (Commission de Surveillance du Secteur Financier, CSSF) under no. B00000351 services electronic and card payments by PAYPAL.COM.
- The Company Dotpay Spółka Akcyjna with its registered offices in Cracow (address: ul. Wielicka 72, 30-522 Cracow), entered into the Register of Entrepreneurs of the National Court Register under no. 0000296790 services electronic and card payments by DOTPAY.PL.
- The Company PAYu SA with its registered offices at ul. Grunwaldzka 182, 60-166 Poznań, entered into the Register of Entrepreneurs of the National Court Register under no. 0000274399 services electronic and card payments by PAYu.pl. The Service Provider shall not be responsible for malfunction of agents’ online services that service electronic and card payments.
- The Service Provider shall not be responsible for impossibility to finalize electronic payment by a Client’s payment card.
- Audio Guide equipment may also be rented in tourist information office, excluding online service, and paid for in cash according to current price list applicable in tourist information office.
- COSTS, MANNERS AND DATES OF DELIVERY AND COLLECTION OF A TICKET/ VOUCHER/ CODE
- A ticket/ voucher/ code is delivered by sending an email on address provided in order form by a Client.
- A ticket/ voucher/ code is delivered to a Client’s e-mail address promptly after Service Provider receiving payment confirmation for a chosen ticket or code, from online payment provider.
- Any installed PDF reader on Client’s private device is needed to read a ticker/ voucher/ code.
- The Service Provider shall not be responsible for lack of possibility to read PDF file due to lack of installed PDF reader/ viewer on a Client’s private device.
- Client shall type (or scan if there is QR code on a ticket) the purchased unlock code for Audio Guide Gdańsk App Broadcast in approrpiate place in the menu of Audio Guide Gdańsk App, downloaded from Google Play service
- RENTAL AND RETURN OF AUDIO GUIDE EQUIPMENT
- Ticket/voucher is valid for 6 months from the day of receiving it. Unused ticket does not authorise a Client to ask for return of paid price.
- Rental of Audio Guide equipment is possible only in tourist information office. The opening hours are listed at the page www.visitgdansk.com. To rent Audio Guide equipment you must identify yourself on the basis of an identity document that is id. card, and, in the case of foreigners – id. card, passport or driving license.
- Audio Guide equipment is rented as at the moment of handing over a device to a Client in tourist information office until closing time of that office on the same day.
- In the case of delay in returning Audio Guide equipment, a Client is obliged to pay full price of rental (without discounts, even though they were granted) for each started day of delay.
- A Client undertakes to use Audio Guide equipment in accordance with its purpose.
- A Client undertakes not to introduce any repairs or modifications to Audio Guide equipment on their own.
- A Client undertakes not to provide Audio Guide equipment to third parties.
- A Client holds exclusive responsibility for loss or any damage of Audio Guide equipment, caused by misuse. A Client is obliged to cover any costs of repair or recovery of a damaged/ lost Audio Guide equipment in the amount not exceeding EUR 100 per one Audio Guide device.
- BOOKING EQUIPMENT
- The online service does not allow for booking Audio Guide equipment.
- Free booking of Audio Guide equipment is possible only by telephone in tourist information office.
- FILING A COMPLAINT ABOUT AUDIO GUIDE EQUIPMENT
- The basis and scope of Service Provider’s responsibility towards a Client in the case of physical or legal defects of Audio Guide equipment are defined in the provisions of the Polish law.
- A Client can file a complaint in writing or in person in tourist information office or by sending a letter to the Service Provider’s address or by electronic means: biuro@audioguidegdansk.pl
- The seller shall immediately respond to a complaint, but no later than within 14 calendar days from the day of filing a complaint. If a complaint is recognised, the Service Provider undertakes to immediately perform service, but not later than within 14 calendar days from the day of recognising a complaint.
- The Service Provider’s responsibility in the scope of lost profits and remedy shall be precluded, whereas the only form of compensation is return of ticket price paid by a Client.
- WITHDRAWAL FROM A CONTRACT
- A Client is entitled to withdraw from a ticket purchase contract concluded by electronic means without giving any reason and without bearing costs within 14 calendar days from the day of concluding a contract.
- A Client is not entitled to withdraw from an equipment rental contract in tourist information office.
- A Client is not entitled to withdraw from a contract for purchasing unlock code for Audio Guide Gdańsk App Broadcast after paying for a code.
- Declaration on termination of a ticket purchase contract concluded by electronic means may be sent by a letter to the Service Provider’s address or by electronic means at: biuro@audioguidegdansk.pl
- SETTLEMENT OF DISPUTES
- Any disputes resulting from implementation of the contract shall be settled by provisions of the Polish substantive law and the Polish judicial procedures.
- A Client is entitled to use out-of-court manners of settling and pursuing claims. Detailed information is to be found at:

- PRIVACY POLICY
- Client’s personal data is processed in accordance with the Privacy Policy, available at: https://audioguidegdansk.pl/en/privacy-policy/
- Each person whose personal data is processed has the right to review its contents and undertake activities defined in the Privacy Policy.
